On Friday, September 4, a federal judge in Boston blocked the USPS from forcing a new set of mail ballot rules on the entire country, with just sixty days until the midterms.
Millions of people who vote by mail will still be able to use the postal service to deliver their ballots, at least for now.

What is Democracy Docket?
Democratic Elections lawyer Marc Elias launched it on March 5, 2020, with no staff and no subscribers. Six years later, he says it employs 22 people, reaches more than 400,000 free subscribers and has over 60,000 paying members.
The research team maintains a database of more than 1,000 election cases and posts court filings in real time, so you don't need a PACER (Public Access to Electronic Court Records) account or a law degree to read the actual court documents.
For the people who aren't fluent in legalese, Democracy Docket publishes explainers on court cases. There's also a YouTube channel with over 600,000 subscribers where you can watch pro-democracy voices discuss the current state of the legal battle to save democracy.

Who is Marc Elias, ‘Defender of Democracy?’
Elias is a Democratic elections lawyer. He was general counsel to John Kerry in 2004 and Hillary Clinton in 2016. He was lead counsel in the Al Franken recount, the longest in American history.
He left Perkins Coie (now Ahurst Perkins Coie) in 2021 to start the Elias Law Group.
When Donald Trump's campaign flooded the courts with lawsuits in an attempt to overturn the 2020 election, Elias ran defense on a state-by-state basis.
Trump filed a total of 64 “election fraud” cases. He lost all but one, and like all of the, that case didn't change anything — other than the ability of Kenneth Cheseboro, Ron Eastman, Lin Wood, Rudy Giuliani, and Jenna Ellis to practice law. (Sidney “Release the Kraken” Powell was disciplined and fined, but not disbarred).
The outcome of the 2020 election wasn't saved by a speech. It was saved by lawyers who showed up to hearing after hearing with evidence. The other side showed up to press conferences and Fox News appearances to spread misinformation, conspiracy theories, and lies about massive voter fraud and Trump’s “landslide” victory in 2020.
Marc Elias and Democracy Docket Are Still Winning
Elias isn’t a retired official offering takes from the sidelines. He's still litigating, and his firm has brought roughly 30 cases against the Justice Department over its push to collect state voter data.
As of mid-August, he counted the DOJ at 0-23 in that fight. The Department of Justice won zero out of 23 cases. Some might call that a ‘losing streak.’
We call it a demolition.
Which is exactly why Elias was able to anticipate the administration's next move — deploying 1,000 election monitors to polling places, announced by Harmeet Dhillon — in an attempt to do something outside the courthouse that it couldn't do in the courtroom.
The Fascists Came for Him — It’s Personal
In March 2025, the White House issued a memorandum naming Elias and his firm directly. Around the same time, other elite firms were being hit with executive orders stripping security clearances and building access.
Nine of them cut deals, collectively promising close to $1 billion in free legal work for causes the administration likes.
Elias said there would be "no negotiation" about his clients or his cases. He's still bringing them.
Another Honest Admission

On April 29, 2026, the Supreme Court ruled 6-3 in Louisiana v. Callais and rewrote Section 2 of the Voting Rights Act to the point that Justice Kagan, in her dissent, called it all but a dead letter.
Days later, Louisiana's governor suspended a primary election after more than 100,000 people had already voted, just so the legislature could redraw the map.
In August, the Supreme Court lifted an earlier order blocking Trump's mail voting directive. Missouri Republicans are asking the justices to restore a gerrymander in time for November. Friday's mail ballot ruling is already on appeal.
Nobody at Democracy Docket is telling you this is okay — “totally normal.”
It’s the Best Source for Optimism and Hope
Hope that can't survive a confrontation with the facts isn't real hope. What Marc Elias and Democracy Docket are offering is the real thing: a running scoreboard in a battle that’s genuinely being fought and frequently being won.
