Fox News and Republicans in Congress were not impressed by the order from Judge Biery.
In Minnesota, a five-year-old boy and his father were detained and transported to a Texas detention center under circumstances later misrepresented by DHS officials and JD Vance. U.S. District Judge Fred Biery ordered their release, rebuking the Trump administration and ICE for their “lack of humanity.”
In a scathing order, Judge Biery used sophisticated language to dismantle the administration’s tactics, writing:
“…the perfidious lust for unbridled power and the imposition of cruelty in its quest know no bounds and are bereft of human decency.”

One has to wonder if the judge chose the words he used specifically to force Kristi Noem to reach for a dictionary. Maybe he wanted to criticize them without their knowledge? (Tell me what you think in the comments.)
Unfortunately, this incident is part of a broader pattern; by staking out courthouses to arrest those attending asylum hearings, ICE continues to actively disincentivize the very legal behaviors the system claims to require.
Standard procedure requires asylum-seekers to attend mandatory check-ins, allowing the government to track them while they demonstrate their intent to comply with the law. However, ICE has been subverting this process by tricking immigrants into “early” check-ins, only to detain them upon arrival. This “trap” sends a dangerous message: compliance leads to deportation.
This counterproductive strategy is a hallmark of the current mass deportation operation. Rather than focusing on “the worst of the worst,” DHS and ICE utilize “dirty tactics” to meet daily quotas, targeting individuals without criminal records who are simply following the rules.
Judge Biery’s sophisticated rebuke channels a widespread public frustration. Meanwhile, the order has sparked a predictable backlash on the Right; Republican Senator Mike Lee has already threatened to impeach the Clinton-appointed judge, signaling the widening political rift over these enforcement tactics.
